1. Parties and Purpose

These Terms of Use (“Terms”) are concluded between FONMUSIC LIMITED and the user (“User”) using the FonMusic website, mobile applications and related digital services.

These Terms govern the general rules for the use of the FonMusic platform, the rights and obligations of the parties and the terms of access to the service.

2. Scope and Acceptance

Anyone using the FonMusic website, mobile application, user account or related digital services declares that they have read, understood and accepted these Terms.

Special provisions regarding the purchase of paid subscriptions offered through FonMusic can also be regulated in the Distance Sales Agreement and Preliminary Information Form. Issues regarding the processing of personal data are included in the Privacy Policy and KVKK Information Text, and issues regarding cookies are also included in the Cookie Policy.

3. Description of Service

FonMusic is a digital platform that offers users access to music content in the digital environment, online listening, offline access within certain features and premium features depending on the subscription plan.

Features offered within the scope of FonMusic; It may vary depending on the country where the user is located, the device he/she uses, the subscription plan he/she chooses, technical requirements, license limitations, content availability and platform updates.

4. Membership and Account Security

It may be necessary to create a user account to benefit from certain features of FonMusic.

User:

  • the information provided during registration is correct, up-to-date and complete,

  • is personally responsible for protecting your login information and account,

  • will not share your account with third parties,

  • may be responsible for the transactions carried out through his account, to the extent of his fault.
  • accepts.

    FonMusic reserves the right to suspend the relevant account, limit access or close the account if it detects unauthorized use of the account, a security breach or was created with false/deceptive information.

    5. Terms of Use

    The User agrees to use FonMusic only in accordance with the law, morality and these Terms.

    The following acts are prohibited:

  • Sharing the account with others or using someone else's account without permission,

  • Attempting to bypass the security measures of the platform,

  • attempting to circumvent signed connection, access control, subscription verification, encryption or similar technical protections,

  • Attempting to analyze the source code, data structure or technical infrastructure of the platform by reverse engineering, scraping, automatic querying, use of bots or similar methods,

  • copying, reproducing, distributing, republishing or presenting the contents to third parties in ways not expressly permitted by FonMusic,

  • use of the service for spam, malware, unauthorized access attempts, fraud, payment abuse or illegal activities,

  • Use of FonMusic in violation of the rights of other users or rights holders.
  • 6. Subscription and Free Use

    FonMusic may offer free and/or paid usage tiers. Certain content, features or listening/offline access may only be available as part of a premium subscription.

    Subscription plans, prices, content coverage and specifications may change over time. Pricing, renewal, cancellation, withdrawal and return conditions for paid services are regulated according to the purchasing channel, as well as in the relevant contracts and rules of the payment infrastructure.

    For web subscriptions, the current rules of Paddle and its integrated subscription infrastructure may apply, and for mobile subscriptions, the current rules of the Apple App Store and Google Play may apply.

    7. Rights in Content

    Music recordings, sound files, designs, interfaces, software, brands, logos, texts, images, databases and all other content on the FonMusic platform; It belongs to FonMusic, its licensors or relevant rights holders.

    The User is granted a limited, revocable, non-transferable and non-exclusive right to use the FonMusic services solely within the scope of these Terms and the relevant subscription plan. This right does not mean that ownership of the content or intellectual property rights are transferred to the user.

    Off-platform use, commercial use, license scope or permitted use scenarios of musical content accessed through FonMusic may also be subject to a license agreement or special terms of use. Any commercial, public or redistribution use of the contents is prohibited unless expressly permitted.

    8. Offline Access and Technical Protection Measures

    FonMusic may offer offline access to users within the scope of certain plans or technical possibilities. This feature does not mean that the user acquires unlimited, indefinite or independent ownership rights to the content.

    The Platform may keep the content downloaded or stored on the device for offline access in encrypted form for security and license protection, associate access with subscription status, impose a time limit or impose a technical verification requirement.

    The User agrees that he/she will not take any action to circumvent, resolve, remove or make available to third parties these protection measures.

    9. User Content and Notifications

    The user is responsible for the legality of user-created playlist names, profile information, support requests, feedback or other content submitted to the platform.

    The User agrees that the feedback, suggestions or error reports provided to FonMusic may be used for the purpose of improving the service. This use does not eliminate the user's rights regarding his personal data.

    10. Continuity of Service and Changes

    FonMusic does not warrant that the service will be uninterrupted, error-free or available at all times. Temporary interruptions, slowdowns, changes or restrictions in service may occur due to maintenance, updates, technical malfunctions, infrastructure changes, third-party service outages, license changes, security measures or force majeure events.

    FonMusic may change, discontinue, remove or limit the use of certain features of all or part of the platform with prior notice or immediately if necessary.

    11. Suspension and Termination

    FonMusic may temporarily or permanently limit, suspend or terminate the user's access to the service in the following cases:

  • violation of these Terms,

  • suspicion of unlawful use,

  • payment abuse or unauthorized transaction,

  • emergence of security risk,

  • use that causes harm to the platform, other users or rights holders,

  • official request or legal obligation.
  • Closing the account or terminating access does not eliminate the user's payment obligations, legal responsibilities or FonMusic's rights due to past violations.

    12. Personal Data, Cookies and Communication

    FonMusic processes the user's personal data in accordance with the relevant legislation and its own Privacy Policy and KVKK Information Text.

    FonMusic website and applications may use cookies or similar technologies for technical requirements, security, performance, preference management and user experience purposes. Detailed information is included in the Cookie Policy.

    Account, security, payment, subscription, renewal, cancellation, support and similar transactional notifications required to provide the service can be sent to the user to the extent permitted by the relevant legislation. Applicable approval and rejection rules also apply for commercial electronic messages.

    13. Third Party Services

    FonMusic may benefit from third-party payment, subscription, hosting, database, content distribution, cloud infrastructure, customer support or similar service providers within the scope of providing the service.

    The Platform may include third-party links, tools or services. FonMusic has no direct control over third parties' own systems, content, policies or terms of service. User's use of these services may also be subject to the relevant third party's own terms.

    14. Limitation of Liability

    FonMusic, without prejudice to its responsibilities arising from the mandatory legislation in force, shall be liable for any indirect, incidental or consequential damages arising from the use or inability to use the service; cannot be held responsible for damages such as data loss, loss of income, loss of reputation or loss of business, to the extent legally permitted.

    FonMusic's liability is in any case limited to the provisions of the mandatory consumer legislation in force.

    15. Change to Terms

    FonMusic may update these Terms of Use from time to time. The current text shall be valid from the date of its publication or shall enter into force on a separately specified date.

    In case of material changes, an appropriate notification can be made to the user. The User's continued use of the service after the updated Terms means that he/she accepts the new text.

    16. Applicable Law and Dispute Resolution

    Turkish law applies to these Terms.

    The user can first forward his/her requests and complaints to FonMusic via the address `support@fonmusicapp.com`.

    Consumer Arbitration Committees and Consumer Courts are authorized in disputes regarding users who are consumers, within the monetary limits stipulated in the current legislation.
