FonMusic terms of use, privacy policy, and legal rights.

DISTANCE SALES CONTRACT

1. Parties

This Distance Sales Agreement ("Agreement") has been established electronically between, on the one hand, FONMUSIC LIMITED ("Seller" or "Provider"), whose information is given below, and on the other hand, the consumer ("Consumer") who purchases a paid digital subscription service through the FonMusic platform and/or 'fonmusicapp.com'.

By approving this Agreement, the Consumer declares that he has been provided with preliminary information regarding the service subject to the contract and that he has read, understood and accepted the provisions of the Agreement.

2. Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties regarding the Consumer's use of paid digital subscription services offered through FonMusic.

FonMusic; It is a digital service that offers access to digital music content over the internet, online listening, secure storage for offline use within certain plans, and the opportunity to benefit from premium features depending on subscription status.

3. Nature and Scope of the Service

The service offered within the scope of FonMusic is a periodic subscription service provided in digital environment. The consumer receives access to the FonMusic content library and relevant premium features according to the scope of the plan purchased.

Scope of service; may vary depending on the selected subscription plan, device compatibility, technical requirements, license scope, content availability and platform updates.

The Seller may apply technical measures such as account verification, subscription control, session management, secure connection, access limitation, encrypted offline storage and similar measures for service security and license protection.

4. Creating the Order and Establishing the Contract

The consumer creates his order by reviewing the total price, including duration, fee, currency, renewal information and tax, if any, for the subscription plan he has selected through FonMusic, at the payment stage.

The contract is established upon the Consumer's electronic approval and successful completion of the payment.

The seller may benefit from third-party payment and subscription infrastructures in payment, subscription management, renewal, cancellation, customer portal and related operational processes.

5. Subscription Term and Automatic Renewal

Subscription is initiated through the monthly, annual or other periodic plan selected by the Consumer.

Unless canceled by the Consumer, the subscription will automatically renew in accordance with the applicable renewal rules of the relevant purchasing channel and the valid subscription fee will be charged to the registered payment method on the renewal date.

In subscriptions initiated via the web, renewal, collection and subscription management processes are subject to the applicable rules of Paddle and its integrated subscription infrastructure.

Renewal, collection and subscription management processes for subscriptions initiated via the mobile application via the App Store or Google Play are subject to the applicable subscription, billing and renewal rules of the Apple App Store and Google Play, respectively.

The subscription fee, plan duration, renewal date, currency, tax information, if any, and basic terms of renewal are displayed to the user on the relevant payment screen before completing the purchase.

6. Cancellation Policy

The consumer can cancel his subscription through the channel from which he purchased it.

For subscriptions initiated via the web, cancellations are carried out through the Paddle customer portal, account settings, payment link or support channels and in accordance with Paddle's applicable rules.

Subscriptions initiated via the mobile application via the App Store or Google Play are canceled via the user account subscription management screen of the relevant platform. Cancellation of these subscriptions is subject to the applicable cancellation and subscription management rules of the Apple App Store or Google Play.

Unless expressly stated otherwise by the relevant platform, the canceled subscription remains active until the end of the current billing period, during which the user can continue to benefit from the relevant subscription rights.

Deleting the application, logging out of the account, or not using the service does not alone mean cancellation of the subscription. The subscription must also be canceled via the relevant payment channel.

7. Right of Withdrawal

The consumer's legal rights regarding the right of withdrawal are reserved.

However, since the service subject to this Agreement is a digital service and digital content access that can be performed instantly in the electronic environment; If the user is immediately granted subscription access, premium features are activated, or the digital service is started to be used, the right of withdrawal may be limited or eliminated to the extent permitted by the relevant legislation.

Withdrawal, cancellation and refund processes, if any, in web subscriptions are evaluated together with Paddle's current rules, without prejudice to mandatory consumer legislation.

Withdrawal, cancellation and refund processes, if any, in mobile subscriptions are evaluated within the framework of the applicable rules of the Apple App Store or Google Play, without prejudice to the mandatory consumer legislation.

8. Return Policy

Refund requests; It is evaluated by taking into account the purchasing channel, the platform from which the payment is received, whether the service has started or not, the relevant platform rules and the applicable consumer legislation.

Refund processes for subscription payments made via the web are carried out within the framework of Paddle's applicable refund, cancellation and payment rules. The user can submit a refund request for the web subscription through support channels or relevant payment/subscription management tools.

Refund requests for mobile subscriptions made through the App Store are evaluated within the scope of Apple's current purchase, subscription cancellation and refund rules.

Refund requests for mobile subscriptions made through Google Play are evaluated within the scope of Google Play's current purchase, subscription cancellation and refund rules.

Refunds for the subscription period that has already been used may not be made unless there is a clear regulatory obligation, technical error, repeated collection, unauthorized transaction or a refund reason accepted by the relevant platform.

The user's mandatory return and application rights arising from mandatory legislation are reserved in any case.

9. Service Delivery and Technical Conditions

In order to benefit from the service, internet connection, supported device or browser, current application version, user account and necessary technical infrastructure are required.

Sales person; may make temporary interruptions, limitations or changes in the service due to maintenance, updates, security, infrastructure improvement, license management, third party service interruptions or force majeure.

Subscription right is defined only for the relevant user account. In case of misuse of the account, sharing with third parties, abuse of the payment system, circumvention of security measures or unlawful use of the service, the Seller may take the necessary technical and legal measures, without prejudice to its rights arising from the legislation.

10. Personal Data

Consumer's personal data; It may be processed for the purposes of creating memberships, carrying out subscription processes, managing payment and renewal transactions, responding to customer support requests, performing security checks, providing services and fulfilling legal obligations.

Details regarding the processing of personal data are also regulated in the FonMusic Privacy Policy and KVKK Information Text.

11. Evidence Agreement

In case of dispute, the Seller's commercial books and records, electronic system records, subscription records, payment records, log records, e-mail records and other digital records may be taken into account as evidence. Consumer's rights arising from mandatory legislation are reserved.

12. Applicable Law and Jurisdiction

Turkish law applies to this Agreement.

In case of dispute, the Consumer may first forward his/her application to the Seller via the address `support@fonmusicapp.com`.

Consumer Arbitration Committees and Consumer Courts are authorized within the monetary limits stipulated in the current legislation.

13. Enforcement

By approving this Agreement electronically, the Consumer is deemed to have accepted all its provisions. This Agreement shall enter into force on the date it is approved electronically.
