1. Parties

This End User License Agreement (“License Agreement”) is concluded between FONMUSIC LIMITED and the end user (“User”) using the FonMusic website, mobile applications and related digital services.

2. Subject of the Agreement

The subject of this License Agreement is to determine the scope of the usage license for the FonMusic application, web interface, software components, musical content, visual materials, database elements and related digital services.

3. Nature of the License

FonMusic grants the User a limited, non-exclusive, non-transferable, non-sublicensable and revocable usage license under this Agreement, valid for personal use only.

This license:

  • does not imply transfer of ownership,

  • does not imply transfer of authorship or intellectual property rights,

  • It does not give the User the right to use the content independently of the platform.
  • 4. Scope of License

    The User may have the following rights under this license:

  • Accessing and using the FonMusic application or web service,

  • Listening to music content within the platform as much as the subscription plan allows,

  • create, save or manage playlists within the scope of the features offered, if any,

  • To store the contents in an accessible format within the application for offline use, as far as the subscription plan and technical conditions allow.
  • Offline access feature does not mean that the content is sold, transferred or left indefinitely to the User. Content downloaded or stored on the device within the scope of offline access can only be used within the FonMusic service and within the framework of technical protection measures.

    5. Limits of the License

    The user uses the contents and software offered within the scope of FonMusic:

  • cannot copy, reproduce, distribute, sell, rent or lend,

  • cannot transmit, transfer or sublicense to third parties,

  • may not publicly publish, broadcast or make available for commercial use,

  • cannot independently archive, reproduce or use in a different service by removing it from the platform,

  • cannot decompose, modify or neutralize technical protection measures by bypassing them.
  • In addition, the User can view the music content on FonMusic; cannot be used for synchronization purposes in videos, advertisements, social media content, podcasts, broadcasts or any other project.

    6. Prohibited Uses

    The following uses are expressly prohibited:

  • sharing the account or unauthorized use of someone else's account,

  • bypassing access control, subscription authentication, signed link, encryption or similar security measures,

  • using automatic tools, bots, scripts or data scraping methods to download, copy or transfer content,

  • subjecting the software to reverse engineering, attempting to extract the source code or analyzing the system architecture,

  • Any use that violates the financial or moral rights of the rights holders,

  • use contrary to applicable legislation.
  • 7. Rights Regarding Musical Content

    All intellectual property rights over the musical content offered through FonMusic belong to FonMusic, its licensors or relevant rights holders.

    The right granted to the User is the right to listen only within the FonMusic platform and to have limited access to the extent expressly permitted by the relevant subscription plan. This right does not grant any right to independent disposition, reuse, redistribution or commercial exploitation of the content.

    The User acknowledges that any content accessed through FonMusic may be subject to copyright, related rights or other intellectual property protections.

    8. Software License

    All rights on the FonMusic application, web interface, software codes, designs, user interface elements, database structure and technical components belong to FONMUSIC LIMITED or its licensors.

    The User is allowed to use the software only to the extent necessary to benefit from the service. User:

  • cannot copy the software,

  • cannot change,

  • cannot adapt,

  • cannot reproduce,

  • cannot take it apart,

  • cannot perform reverse engineering,

  • cannot create derivative works.
  • The applicable platform rules of the Apple App Store and Google Play may also apply to versions downloaded through the relevant application stores.

    9. Offline Content and Technical Protection Measures

    FonMusic may store certain content or features encrypted for security and license protection, associate offline access with the subscription period, apply access keys, time limits, device-based verification or technical usage limitations.

    The User agrees not to attempt to circumvent these technical protection measures, decrypt, copy, export or reuse them for any other commercial or personal purpose.

    If the subscription expires, is suspended, canceled or cannot be verified, offline access rights may be restricted or terminated.

    10. License Term and Expiration

    This license comes into force on the date the User starts using FonMusic services and continues until one of the following events occurs:

  • Closing the User's account,

  • subscription period has expired or is not renewed,

  • The User violates this Agreement,

  • FonMusic terminates the service or relevant license,

  • termination of access due to technical, legal or licensing obligations.
  • If the license expires, the User's right to access the content, offline usage rights and in-application licensed usage rights may also expire.

    11. Consequences for Violation

    If the User violates this Agreement, FonMusic;

  • suspend or close the account,

  • restrict access to content,

  • terminate offline access rights,

  • Take the necessary technical and legal measures,

  • reserves the right to take legal action.
  • This does not eliminate FonMusic's right to demand compensation for the damage suffered.

    12. Limitation of Liability and Warranty

    FonMusic may provide the service "as is" and "to the extent available", without prejudice to its obligations arising from the mandatory legislation in force.

    FonMusic does not guarantee that the service will be uninterrupted, error-free, compatible on all devices or available at all times. Changes or interruptions in service may occur due to technical malfunctions, maintenance work, third-party service outages, license changes, content removals or security measures.

    13. Intellectual Property Infringement Notification

    If a user or rights holder believes that a content on FonMusic violates their intellectual property rights, they can forward their request to `support@fonmusicapp.com`.

    FonMusic reserves the right to review the relevant content, temporarily remove it, limit access or initiate necessary legal and technical proceedings when deemed appropriate.

    14. Applicable Law and Disputes

    Turkish law applies to this License Agreement.

    Consumer Arbitration Committees and Consumer Courts are authorized in disputes regarding users who are consumers, within the monetary limits stipulated in the current legislation.
